Terms of Service

These Terms of Service ("Terms") apply to creators who apply to join the Vibes creator network at gettingvibes.com ("Vibes", "we", "us"). By submitting a creator application, you agree to these Terms.

1. What Vibes Does

Vibes is a creator marketing platform that connects content creators with brands for paid and gifted campaign collaborations. We review creator applications, match creators to brand campaigns, and facilitate payments upon content delivery.

2. Your Profile and Public Data

By applying to join the Vibes network, you consent to the following:

• Your name, social media handle(s), content niche, location, and rate card may be shared with brand partners on the Vibes platform for the purpose of campaign matching.
• Publicly available metrics from your social media profiles - including follower count, average engagement rate, and average video views - may be displayed on your Vibes creator profile and shared with brands.
• A short AI-generated summary of your content style and audience may be shown alongside your profile to help brands assess fit.
• Your profile may be featured on the public-facing Vibes creators page at gettingvibes.com/creators.

All metrics displayed are sourced from publicly available data on your social media profiles. We do not access private account data.

3. Campaign Participation

Being accepted into the Vibes network does not guarantee campaign work. Brands select creators based on fit for each specific campaign. When matched to a campaign, you will receive a brief outlining deliverables, deadlines, and compensation before you accept.

Accepting a campaign brief constitutes an agreement to deliver the specified content by the agreed deadline. Vibes reserves the right to withhold payment for content that does not meet the brief requirements.

4. Payments

Creators are paid within 5 working days of their content being approved and posted. Payment is made via bank transfer or PayNow to the details provided. Vibes does not charge creators any fees or commission.

5. Content Ownership and Usage Rights

You retain ownership of the content you create. By participating in a Vibes campaign, you grant the brand and Vibes a non-exclusive licence to repurpose your content for paid and organic marketing across all platforms for 12 months from the date of posting, unless otherwise specified in the campaign brief.

6. Your Rights

You may request removal from the Vibes creator network and deletion of your profile data at any time by emailing hello@gettingvibes.com. We will process removal requests within 7 business days. Removal will not affect any campaigns you are mid-way through.

Under Singapore's Personal Data Protection Act (PDPA), you have the right to access, correct, and withdraw consent for the use of your personal data. Contact us at the email above to exercise these rights.

7. Your Responsibilities

• You must own or have the right to post all content you submit through Vibes campaigns.
• You must comply with the advertising disclosure requirements of the platforms you post on (e.g. #ad, #sponsored, paid partnership labels).
• You must not misrepresent your follower count, engagement, or audience demographics.
• You must be 18 years of age or older to join the Vibes network.

8. Non-Circumvention

Where Vibes introduces you to a brand or facilitates a connection between you and a brand through the platform (a "Vibes-Introduced Brand"), you agree not to enter into any paid or gifted collaboration, sponsorship, or commercial arrangement directly with that brand - or through any third party other than Vibes - for a period of 12 months from the date of first introduction.

This clause does not apply to brands you had an existing commercial relationship with prior to joining the Vibes network. If you believe a brand falls into this category, you should notify us at hello@gettingvibes.com before accepting any campaign involving that brand.

Breaching this clause may result in immediate removal from the Vibes creator network and Vibes reserves the right to claim damages equivalent to the commission that would have been earned on the circumvented arrangement.

9. Limitation of Liability

Vibes acts as an intermediary between creators and brands. We are not liable for a brand's failure to pay, changes to a campaign brief, or any dispute between you and a brand arising from content creation. We will assist in resolving disputes where possible.

10. Changes to These Terms

We may update these Terms from time to time. We will notify active creators by email of any material changes. Continued participation in the Vibes network after notification constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.
